By booking, paying for, or participating in any experience, transportation, or concierge service provided by After Dark Rainforest Experiences by D&H (hereinafter "After Dark", "we", "us", or "the Company"), the Client confirms that they have read, understood, and accepted these Terms and Conditions in full, on their own behalf and on behalf of every member of their party, including minors.The person making the booking ("the Lead Guest") warrants that they have the authority to accept these Terms on behalf of all travellers in their party and is responsible for ensuring that all members of the party are aware of them.

Tours, transfers, and concierge services are not considered confirmed until your booking has been completed and you have received a written booking confirmation from After Dark. Verbal or informal expressions of interest, including WhatsApp conversations prior to confirmation, do not constitute a reservation and do not hold a date.All bookings are subject to availability of guides, vehicles, and third-party partners. Requests received for the same date are honored in the order in which payment terms are met.Please review your confirmation carefully upon receipt and notify us immediately of any error in names, dates, pickup location, or party size. After Dark is not responsible for costs arising from incorrect information provided by the Client.

Payment terms are specified at the time of quotation and stated in your booking confirmation. Unless otherwise agreed in writing:A deposit is required to confirm and hold your date.The remaining balance is due prior to the start of the service.Accepted payment methods and any applicable processing fees are disclosed at the time of booking. All prices are quoted in United States Dollars (USD) unless expressly stated otherwise, and are subject to applicable Costa Rican taxes. Prices quoted are valid for the party size and dates specified in the quotation; changes to either may require a revised quotation.Card processing fees, bank fees, payment platform fees, currency conversion differences, and international transaction charges applied by your bank or card issuer are the responsibility of the Client and are not refundable under any circumstance (see Section 6).

Each experience page and each written quotation specifies exactly what is included. Unless expressly listed as included, the following are not covered: international or domestic airfare, accommodation, travel insurance, personal expenses, additional food and beverages, entrance fees not itemized, gratuities, and any optional activity added on the day of service.Where an experience includes meals, beverages, entrance fees, or third-party activities, these are provided as described. Unused inclusions have no cash value and are not refundable or exchangeable.

All cancellations must be made in writing and sent to info@afterdarkrainforestexperiences.com or to our official WhatsApp numbers. The request must state the Lead Guest's name, the number of travellers, the date, and the name of the tour or service.A cancellation is effective only from the moment our team confirms receipt in writing. Where a refund applies, it will be issued in accordance with Section 6.Refunds are determined by the following terms:More than 48 hours before the scheduled service: eligible for a full refund of the tour price. We appreciate your timely notice, which allows us to manage our operations efficiently.Between 24 and 48 hours before the scheduled service: a 50% cancellation fee applies. This partial charge covers preparation and logistical arrangements already underway.Less than 24 hours before the scheduled service: non-refundable. By this point, guides, vehicles, partners, and provisions have been committed on your behalf and the costs are not recoverable. Multi-day itineraries, concierge packages, and experiences involving third-party suppliers or private venue reservations may carry their own cancellation terms, which will be disclosed in writing at the time of booking and which prevail over the schedule above.In all cases, After Dark does not issue refunds, credits, or discounts for late cancellations, no-shows, or unused portions of a booked service.

We are committed to processing every eligible refund fairly, transparently, and without delay.Our processing time. Once a refund has been approved, After Dark will initiate the refund immediately, and in all cases within one (1) business day of approval. You will receive written confirmation once it has been released on our end.Your bank's processing time. Once we have issued the refund, the time it takes for the funds to appear in your account depends entirely on your bank, card issuer, or payment provider. This typically takes between 5 and 15 business days, but may take longer depending on your financial institution, card network, or country of residence. After Dark has no control over, and assumes no responsibility for, processing times applied by third-party financial institutions once the refund has been released by us.If your refund has not arrived within 15 business days of our written confirmation, please contact your bank or card issuer first, and then reach out to us so that we can provide proof of the refund transaction.Non-refundable fees. Card processing fees, bank fees, payment platform fees, and any transaction charges applied at the time of purchase are non-refundable under any circumstance. These fees are charged by third-party payment processors and financial institutions, not by After Dark, and are not recoverable by us once the transaction is completed. All refunds are therefore calculated on the tour price only, net of any such fees. Currency conversion differences and exchange rate fluctuations applied by your bank at the time of purchase or refund are likewise the sole responsibility of the Client.Method of refund. Refunds are issued to the original method of payment only. We are unable to issue refunds to a different card, account, or person.

We recognize that plans can sometimes change.Our guides and drivers will wait at your pickup location for up to 15 minutes after the scheduled time. If this window is exceeded, we will do our best to reschedule the experience or service based on availability.If we are unable to reschedule, or if the alternative dates offered do not work for you, the Company reserves the right to charge 100% of the tour cost to cover logistics and associated expenses.Please be aware that if we proceed despite a late arrival, we cannot guarantee that the full itinerary can be delivered, as entrance times, wildlife activity windows, sunset timing, and third-party reservations are fixed and outside our control. No refund or partial credit applies to itinerary elements missed as a result of a late start.Guests who do not appear at the pickup location and do not notify us are considered no-shows, and no refund applies.

Requests to change a date, time, pickup location, or party size must be made in writing and are subject to availability and to the terms of any third-party supplier involved.Where a change is requested more than 48 hours in advance and can be accommodated without cost to us, we will gladly make it at no charge. Changes requested within 48 hours of service, or which trigger charges from third-party partners, may incur additional costs, which will be quoted to you before we proceed.A reduction in party size within 48 hours of service does not reduce the price of a private experience, as the vehicle, guide, and reservations have been committed for the group as booked.

Weather. We do not cancel because of rain — rain is part of the experience, and often the best part. However, if in our sole judgement weather conditions are unsafe, the experience will be cancelled or modified. In that case, we will first offer you the option to reschedule at no additional cost, subject to availability. If rescheduling is not possible or does not suit your travel plans, you will receive a full refund of the tour price, processed as described in Section 6.Operational changes. The Client acknowledges that routes, schedules, itineraries, amenities, and mode of transport may be subject to change without prior notice due to circumstances beyond our reasonable control, including illness, mechanical breakdown, road closures, river conditions, incidents at the location, strikes, border or entry difficulties, or extreme weather. Where a substitution of comparable quality is offered and accepted, the service is considered delivered.Safety. At all times, the decision of our guide, driver, or designated representative is final on all matters regarding the safety and wellbeing of guests and the operational requirements of the experience.

The Client acknowledges that the nature of our experiences is adventurous and may involve a significant degree of risk to health and safety, including but not limited to travel on unpaved and mountain roads, walking on uneven, wet, steep, or slippery terrain, night-time activity in the rainforest, exposure to wildlife and insects, river and ocean environments, and remote locations where medical assistance is not immediately available.The Client hereby assumes all such risk and releases After Dark from all claims and causes of action arising from any damage, injury, illness, or death resulting from risks inherent in travel, visiting foreign destinations, and participating in adventurous activities.If any member of the party is affected by any condition — medical or otherwise — that may affect their ability to travel or participate, their enjoyment of the experience, the enjoyment or safety of other guests, or the treatment to be administered in an emergency, the Client must advise After Dark at the time of booking and complete any medical or liability form we reasonably request. Our experiences are tailored to the group and its physical capacity, and we can only do this well if we know in advance.After Dark reserves the right to decline participation, without refund, to any guest whose condition or level of fitness was not disclosed and which, in the reasonable judgement of our guide, presents a risk to that guest or to others.

We warmly welcome families. All guests under the age of 18 must be accompanied by a parent or legal guardian, who remains responsible for their supervision, conduct, and safety at all times throughout the experience.Costa Rican law requires the use of approved child restraint systems in vehicles according to the child's age, height, and weight. Please advise us of the age, height, and weight of all children in your party at the time of booking so that appropriate seats can be arranged.If a required child restraint cannot be provided because the information was not disclosed in advance, we may be unable to transport the child, and no refund will apply.Certain experiences carry minimum age or physical requirements, which are stated on the relevant experience page.

Transportation is provided in licensed and insured vehicles operated by qualified drivers. Guests are required to wear seatbelts at all times while the vehicle is in motion and to follow the instructions of the driver.Pickup and drop-off locations are those stated in your booking confirmation. Additional stops or route changes requested on the day are subject to the driver's discretion, safety considerations, and may incur additional charges.Travel times in Guanacaste and across Costa Rica are estimates. Traffic, road works, weather, and road conditions are outside our control and are not grounds for a refund.

Where alcoholic beverages are included in an experience, they are served responsibly and only to guests of legal drinking age in Costa Rica (18 years and over). Proof of age may be requested.Our guides and drivers reserve the right to refuse or discontinue service of alcohol at their sole discretion. Guests whose behaviour, as a result of alcohol or any other substance, presents a risk to themselves, to other guests, to our staff, or to the operation of the experience may have the experience terminated without refund and will be returned to their accommodation at their own cost. The use of illegal substances during any of our experiences is strictly prohibited.

Where meals or beverages are included, allergies, intolerances, and dietary requirements must be disclosed in writing at the time of booking. We will make every reasonable effort to accommodate them and to communicate them to our partner kitchens.However, our experiences take place in rural and remote settings and many meals are prepared by third parties in shared kitchens. We cannot guarantee a completely allergen-free environment, and we cannot accept liability for allergic reactions. Guests with severe allergies must carry their own medication.

We are guests in the forest, and our experiences depend on it staying wild. By travelling with us, you agree to follow the instructions of your guide regarding wildlife at all times, and specifically:Do not touch, handle, feed, or attempt to hold any wild animal.Do not use flash photography on wildlife; your guide will advise on appropriate lighting.Remain on marked trails and maintain the distances indicated by your guide.Do not remove plants, animals, shells, sand, or any natural material from any site.Do not litter; all waste leaves with us.Wildlife sightings are never guaranteed. Animals are wild and free, and their presence, activity, and visibility cannot be predicted or promised. No refund or partial credit applies to an experience in which a particular species is not observed.Guests who disregard these rules may have the experience terminated without refund.

Certain components of our experiences and all concierge services — including accommodation, restaurants, boats, guides in other regions, entrance-controlled attractions, and specialized activities — are arranged by After Dark with independent local suppliers, who may in turn engage their own operators or sub-contractors.In arranging these components, After Dark acts as an intermediary on behalf of the Client. We endeavour at all times to appoint reputable, licensed, and competent suppliers and to comply with all applicable health and safety laws and regulations. However, the terms and conditions of each supplier apply to the component they provide and are expressly incorporated into these Terms; these may limit or exclude that supplier's liability. The liability of After Dark shall not exceed that of the supplier of any given component.Each component shall be regarded as having been satisfactorily performed and delivered solely by reference to the regulations and laws concerning health and safety in the jurisdiction where that component is operated.Standards of hygiene, accommodation, and transport in some regions may differ from those the Client may reasonably expect in their home country.

Neither After Dark nor its authorized agents shall offer or pay any discount or refund for missed or unused services which were missed or unused by the Client through no fault of After Dark, its agents, or representatives.To the fullest extent permitted by Costa Rican law, After Dark's total liability in connection with any booking shall not exceed the total amount paid by the Client for the service in question. After Dark shall not be liable for indirect or consequential losses, including but not limited to missed flights, missed connections, missed accommodation, or loss of enjoyment.

We strongly recommend that every guest travel with comprehensive travel insurance covering, at minimum, trip cancellation and interruption, medical expenses and emergency evacuation, adventure activities, and loss of baggage and personal effects.Travel insurance is not included in any of our services. The Client accepts full responsibility for any loss, cost, or expense that would otherwise have been recoverable under an appropriate insurance policy.

By travelling with After Dark, the Client agrees to abide by the authority of our guide, driver, or designated representative, and to comply at all times with the applicable laws and regulations of Costa Rica and of every site visited.We reserve the right to refuse service to, or to remove from an experience, any guest whose conduct is, in our reasonable judgement, disruptive, unsafe, unlawful, discriminatory, or disrespectful toward our staff, other guests, local communities, or wildlife. No refund applies, and any resulting costs are the responsibility of the Client.

The Client is responsible for any cost incurred by After Dark, our suppliers, or our partners as a result of damage, destruction, theft, or excess cleaning related to accommodation, vehicles, equipment, rentals, or facilities used during the experience.Guests agree to report any pre-existing damage of this kind to our representative or to the relevant staff as soon as it is discovered.

Guests are responsible for their own personal belongings at all times. After Dark does not accept liability for loss of, or damage to, personal property, including electronics, cameras, jewellery, or documents, whether in our vehicles, at partner venues, or during an experience.Items left behind will be held for 30 days where possible; return or delivery is arranged at the Client's cost.

Discretion is part of the service. We do not publish, share, or discuss the identity, itinerary, or presence of any guest without permission.Our guides may take photographs or video during an experience and offer them to you as a courtesy. These will only be used in our marketing, website, or social media. If you prefer not to be photographed at all, simply tell your guide — no explanation needed.Guests are welcome to take photographs for personal use. Commercial photography, filming, or drone use during an experience requires our prior written authorization and may require permits from the relevant authorities or landowners.

After Dark is committed to keeping all information related to our guests strictly confidential and internal. Information you provide to us — through our website, WhatsApp, email, or booking platforms — is used exclusively to deliver and improve your experience, and is never sold or disclosed to any third party other than the suppliers strictly necessary to deliver the service you booked.We handle personal data in accordance with Costa Rican law on the protection of personal data. You may request access to, correction of, or deletion of your personal data at any time by writing to info@afterdarkrainforestexperiences.com.Online payments are processed through secure third-party platforms that comply with the security standards required by the banks and by VISA, MASTERCARD, and AMERICAN EXPRESS for the secure processing of card data. After Dark does not store your full card details. After Dark remains the sole entity responsible for your reservation.

After Dark shall not be held responsible, and no compensation beyond the refund terms described in Section 6 shall apply, in the case of natural disasters, seismic or volcanic activity, extreme weather, fire, flooding, landslides, road blockages, epidemics or public health measures, strikes, government orders, or any other circumstance beyond our reasonable control.

If any aspect of your experience does not meet the standard you were promised, please tell your guide immediately, while we are still in a position to put it right. Concerns raised on the day can almost always be resolved on the day.If a matter remains unresolved, please write to us at info@afterdarkrainforestexperiences.com within 30 days of the service date, including your booking reference and a description of the issue. We commit to responding within 5 business days.These Terms are governed by the laws of the Republic of Costa Rica. Any dispute arising from them shall be submitted to the competent courts of the Province of Guanacaste, Costa Rica.

We kindly ask that you contact us directly before initiating any chargeback or payment dispute with your bank or card issuer. We are committed to resolving any refund concern promptly and in good faith.Chargebacks filed without prior contact, in respect of services rendered in accordance with these Terms, will be disputed with full supporting documentation, including the booking confirmation, written communications, and these Terms as accepted at the time of booking.

After Dark reserves the right to amend these Terms and Conditions at any time. The version in force at the time of your booking is the version that applies to your reservation.
